Updated Terms of Use: Carolina Vacays (NC Focused)

Effective Date: March 17, 2026

1. North Carolina Vacation Rental Act All bookings are subject to the provisions of the North Carolina Vacation Rental Act (N.C.G.S. Chapter 42A). By confirming a booking, the Guest acknowledges that this is a vacation rental for a period of less than 90 days and that the Guest’s primary residence is elsewhere.

2. Trust Account Disclosures In accordance with NC law, all guest funds (deposits, prepayments, and fees) will be deposited into an interest-bearing trust account at [Insert Name of Bank, e.g., First Citizens Bank]. Interest: Any interest earned on these funds shall accrue to Carolina Vacays.

3. Payment & Security Deposits Payment: A portion of the rent is due at booking, with the final balance due 30 days prior to arrival. Security Deposits: If a security deposit is collected, it will be applied toward any damages caused by the guest. Per NC law, any unused portion will be returned within 45 days of check-out. Damage Waiver: We may offer a non-refundable "Damage Waiver" fee in lieu of a large security deposit.

4. Cancellation & Transfers Standard Policy: [Insert your specific window, e.g., 60 days for a full refund]. Transfers: If the property is sold or the management agreement ends, Carolina Vacays will transfer guest information and funds to the new owner/manager as required by N.C.G.S. § 42A-19.

5. Mandatory Evacuation & Travel Insurance Per NC law (§ 42A-36), if state or local authorities order a mandatory evacuation of the area: Guests are required to comply and evacuate. Refunds: Carolina Vacays is not required to provide a refund for stayed or unused nights if the guest was offered Travel Insurance prior to booking. We strongly recommend purchasing insurance. 

6. Expedited Eviction Guests may be subject to expedited eviction (as outlined in Article 4 of the NCVRA) if they: Materially breach the rental agreement. Fail to pay rent. Occupy the property after their lease has expired.

7. Occupancy & Prohibited Use Occupancy: Limited to the number of guests stated in the listing. Exceeding this limit is a material breach. Events: No weddings, parties, or large gatherings are permitted without prior written consent and an additional event fee. Pets: Only allowed in designated "Pet Friendly" properties with a paid pet fee.
